What is The Family Visa Process?
The United States Citizenship and Immigration Services has two groups of family-based immigrant visa categories; immediate relatives and family preference. Under the immigration and Nationality Act 1995 a foreign national who has a relationship with a U.S. citizen may seek to live permanently in the U.S. through obtaining an immigrant visa.
Immediate Relative Visas – Close family relationship with a U.S. citizen, such as a spouse, child or parent. The number of visas available in this category is not limited each fiscal year. This means that there is no per country quota on the allocation of these visas.
Family Preference Visas – These are designed for more distant family relationships with a U.S. citizen and some specified relationships with a Lawful Permanent Resident (LPR). The number of visas available in this category is limited each fiscal year. This means that per country quotas apply along with how many are allocated yearly for that specific visa category.
Who Can File?
U.S. citizens can file an immigrant visa petition for their:
- Spouse
- Son or daughter
- Parent
- Brother or sister
U.S. Lawful Permanent Residents can only file an immigrant visa petition for their:
- Spouse
- Unmarried son or daughter

What is The Filing Procedure?
- Step 1: Submission of I-130 petition
Collation of documentation that prove the relationship between the U.S. citizen and foreign national and submission of form to United States Citizenship and Immigration Services for approval.
- Step 2: Submission of application to National Visa Center for processing
Once the I-130 petition has been approved the application will be moved to the National Visa Center for allocation of a visa once it is available.
- Step 3: Consular Interview
Once all supporting documents have been submitted and approved both the U.S. citizen and foreign national will have to schedule an appointment with the Embassy for an interview. The interview will further be proof to the United States of the legitimacy of the relationship.
What Are The Family Visa Sponsorship Document Requirements?
- U.S. citizen passport, birth certificate or naturalization certificate
- Lawful permanent resident copy of green card.
- The U.S. citizen or lawful permanent resident must be 21 years of age or older.
- Proof of bona fide relationship with the U.S. citizen or lawful permanent resident.
- Evidence supporting the U.S. citizen or lawful permanent resident can financially support the foreign national in the U.S.
- Evidence supporting the U.S. citizen or lawful permanent resident compliance with U.S. tax regulations.
- Evidence supporting the U.S. citizen’s ties to the U.S.
